Conditional Residence/Problems in the Marriage

Sometimes there are problems in a marriage during the time that a beneficiary has conditional residence (a two-year green card). In these situations, the petitioner is no longer willing to file jointly with the beneficiary to make the conditional status permanent. We assist beneficiaries in filing for permanent residence by themselves without the petitioner when:

  • the marriage has ended through divorce
  • the marriage has ended because the petitioner died
  • the petitioner has battered or been extremely cruel to the beneficiary
